Sub: Notice for initiating action on the basis of defamatory
press reports published in 'The Navhind Times', 'Tarun
Bharat' (Goa), 'O Herald', 'Gomantak' dated 24th September 2003
My client Shri Manohar Prrikar Honourable Chief Minister Government of Goa
has placed in my hands the file containing the papers, records as well as
newspaper reports, and upon perusal of which, on the instructions of my
client I hearby address you this legal notice.
By a separate legal notice dated 26/09/2003; my client has called upon
Shri Luizinho Faleiro; to tender an unconditional apology and have also
issued legal notice to serve him for Rs 10 Crores. The said notice on
behalf of my client has been directly issued to Shri. Faleiro.
By this present notice I on behalf of my clients do hereby call upon you
as under:-
1. Mr Faleiro has committed gross and civil wrongs of the highest order;
for which criminal acts of defamation notice is also given to him. I also
serve upon you this notice for publishing false and defamatory paragraphs
in your newspapers. Such publication does harm and attempt to injure the
rights of my client. Such false acts made by a person and published by
another make also the Editor; publisher and news reporter of such
defamatory articles responsible for such publication, which generally
amounts to defamation, as well as an offence under the Penal Code of the
Country.
2. In the circumstances, I hereby call upon you Nos 1 to 9 to refrain from
in any way publishing any further or other defamatory pieces of statements
made by any persons including Mr Faleiro against my client failing which
my client shall proceed to file an appropriate complaint as well as a suit
against you Nos. 1 to 9 for injunction as well as for recovery of damages
solely at your cost and consequences as to the risk involved in the same.
My client does reiterate that being a public figure, it is necessary for
him to accept criticism even if it be fair or uncalled for. However, under
no circumstances, can a persons reputation, character, integrity be made
the issue for judgement through newspaper publication by making false
statements and publishing them. Hence you Nos 1 to 9 are hereby called
upon to refrain from in any way publishing any articles of statements
which may be made by Mr Faleiro or any one else for that matter failing
which the consequences as stated hereinabove would ensue.
