The petitioner, Savita Dias Sapeco had approached the court requesting that the Goa State Human Rights Commission be established, as envisaged under the Protection of the Human Rights Act 1993.
The petitioner has stated that a mandatory duty has been cast on the State Govt to constitute the State Human Rights Commission and that on account of the non-constitution of the commission, the human rights court has become non-functional. As such, this inaction on the part of the government amounts to breach of its statutory duties.
The non-constitution of the Commission is arbitrary and in violation of Article 14
and 21 of the Constitution of India, states the petitioner.
She has also relied on judgement of 4 human rights petitions disposed of by the Special Judge of the Human Rights Courts at Panjim, filed by private complainants. The judge in these cases has held that the private complainants cannot approach the Human Rights Court without first approaching the Human Rights Commission. ------------------------------ HERALD 28/11/03 page 3 ------------------------------
