The re-inclusion of revenue villages selectively by
the Government in the PDAs on 27.09.2005 (earlier CM
Rane had removed all PDAs in public interest on
4.2.2005 and the controversial Town & Country Planning
Ordinance dated 29.09.2005 seem to be gaining the
attention it deserves from Rane Government.
Today following a memorandum served to both Chief
Minister and Goa Pradesh Congress Committee President
Mr Ravi Sitaram Naik Mr Naik held a meeting with Ms
Victoria Fernandes MLA Santa Cruz & Deputy Speaker of
the Goa Legislative Assembly President of the Santa
Cruz Constituency Citizens Action Committee and other
NGO's
Later on the GPCC had a tete a tete with the CM and
later brought to the notice of the members at a
meeting held at Congress House that Mr Rane in a
signed communique had replied to queries raised by the
NGO's which largely spelt that the ordinance would go
but preferred to have the final say of the Law
Department and that no decisions were taken on basis
of the ordinance.
When the undersigned asked about the agenda of the
North Goa Planning Development Authority relating to
meetings held on 17.10.2005 and 10.11.2005 where in
post facto NOC's were considered under section 44 and
49(6) of the TCP Act 1974 Mr Naik preferred that the
details could be obtained under the Right the
Information Act as he could not answer on the same.
When asked to clarify whether the Draft Regional Plan
2011 now made public to invite suggestions and
objections if any was the same as the one notified
earlier on 6.7.2004 wherein suggestions were already
recieved and according to the circular of the Chief
Town Planner dated 6.5.2005 a committee was
constituted to examine the same Mr Naik could not
clarify on this matter.
He also took note of the fact that the TCP Board in
its 113th adjourned meeting held on 28.11.2003 had
approved the Draft Regional Plan 2011 and notified
the same on 6.7.2004 gazetted on 7.7.2005 and
therefore any changes in land use or zoning was
invalid when this process of finalising the Plan was
on. This is clearly the gist of the circular dated
6.5.2005 Hence it is clear that all those changes
subsequent to 28.11.2005 till date i.e. last two years
were invalid.
Later he was asked to confirm whether the Draft
Regional Plan 2011 in scale 1: 10000 notified on
6.7.2005 had undergone any changes now that it is
notified again for public viewing and suggestions he
clarified that he was not aware of the same.
It waa also brough to his notice that the press
reports and advertisement on the local dailies gave
the deadline as 15.12.2005 and hence was too short for
such an important issue as examination of a regional
plan that would change the landscape of Goa until 2011
and hence he was asked to impress upon the Government
for atleast until February end 2005.
Mr Naik was also informed that the Sub Reguistrar Mr
William Sagar Rebello had confirmed telephonically to
the undersigned that PDA clearance was needed for
registering of documents as the notification of
27.9.2005 including revenue villages in Panaji Vasco
da Gama and Mapusa excluding Ponda and Margao was
still in force and until such time they recieve a
notification removing the revenue villages as assured
by Mr Rane they will have to insist on such NOC's from
the concerned PDA's. Mr Naik was cautioned that being
the holiday season when several Goans come to their
homeland all transactions of sale of land will be
cumbersome as it is in the last two months people were
incovenienced and hence he should ensure that the
Government issues the notification withdrawing all
revenue villages from PDAs fortwith.
Mr Naik categorically stated to the Cable TC network
and other press men that there were no cases cleared
under the controversial ordinance from 29.9.2005 till
date.
Ms Victoria Fernandes however stated that she has yet
to receive a communique from the CM as his statement
that the same was conveyed to her was false. She
reiterated her stand that unless the controversial
ordinance 2005 is repealed, that ALL the revenue
villages are removed from PDAs and any changes in
land use or zoning based on the new ordinance should
be revoked forthwith.
Only then she will be satisfied or else the agitation
may go out of hand for which the Rane Government will
be responsible.
>From the briefing it appeared clear that a positive
action will follow.
As it is the Mopa airport issue is assuming alarming
concern for the Congress Party and with division among
its rank the prospects of the Government is in
jeopardy.
Incidentally the hearings on the Filpe Neri Rodrigues
case has completed and the judgement order is
reserved, later the hearings of Mr Mathany Saldanha
will follow. As regards Mr Rodrigues the non
availability of the original document alleged to be
forged may go against Mr Rodrigues.
