Regardless of the government in power, the judiciary
has to continue to be an ever so watchdog to ensure
that injustice is curbed and the poor are not
oppressed.
Politicians do not like Public Interest Litigations.
But when those in power abuse authority or abdicate
responsibility it is a PIL that can cure the ill. It
is imperative that more and more conscious citizens
take a lead in pursuing PILs rather than expecting and
depending on a few citizens and some NGOs to always
bear the travails of pursuing them.
It would be nice to see our courts being more
proactive and taking suo motu cognisance of public
vows. This would, in a way, help ensure a PIL does
not end up as a Private Interest Litigation, Political
Interest Litigation, Publicity Interest Litigation or
worse still, a Paisa Interest Litigation.
In our country where unfortunately money and muscle
power rules the roost, a PIL can go a long way to
protect the very basic provisions of our Indian
Constitution which time and again seem to be trampled
upon by the rich, mighty and the well connected.
