Expulsion of MPs: court wants all parties to explain

Agencies New Delhi Jan 9: The Delhi High Court today issued notices to
the Lok Sabha, Rajya Sabha, Election Commission and the Centre on a
batch of petitions filed by eight of the 11 expelled MPs caught on
camera taking bribe for asking questions in the Parliament.

A division bench of Mr Justice Vijender Jain and Mr Justice Rekha
Sharma asked the respondents to file their replies to the petition
within two weeks.

The court, however, refused to grant interim relief to the expelled
MPs and posted the matter for hearing on February 13.

The MPs whose petition came up for hearing are Mr Chhatrapal Singh
Lodha (Rajya Sabha), Messrs Suresh Chandel, Pradip Gandhi, Yashwant
Giridhar Mahajan, Anna Saheb M K Patil, Chandrapratap Singh, Manoj
Kumar and Ram Sevak Singh, all of them from Lok Sabha.

Appearing for the MPs, senior counsel, Mr P N Lekhi said the
Parliament did not have the power to expel its members. At the most,
it could suspend them.

The MPs moved the High Court last week, saying they were not given
enough opportunities to defend themselves, and that the Bansal
Committee, set up by the Lok Sabha Speaker, Mr Somnath Chatterjee, had
violated the principle of natural justice.

Mr Chatterjee has said that he had received emails and letters from
across the country supporting the expulsion of the MPs. He said he
would not surrender or submit to the jurisdiction of courts on this
issue.
