Close to 140 Ninth Schedule laws come under judicial scrutiny
New Delhi, Jan 11: A close to 140 of the 284 laws that were placed by
the Parliament in the Ninth Schedule since 1973 is likely to come
under the judicial scrutiny of the Supreme Court, after a nine-member
Constitutional bench today gave its landmark judgement.
The Ninth Schedule, which came into existence after the first
Constitutional Amendment in 1951, was drafted by former Prime Minister
Jawaharlal Nehru. It was kept beyond judicial review so that courts
could not get in the way of socialist policies, such as land reforms.
The list of 139 consists many such land reforms Acts that were placed
by the Parliament. However, it also consists some of the controversial
Acts that were passed by the legislature to avoid judicial scrutiny;
the prominent being the Tamil Nadu Reservation Act.
The list is as follows:

1975 (Goa, Daman and Diu Act 1 of 1976).

77) The Goa, Daman and Diu Agricultural Tenancy (Fifth Amendment) Act,
1976 (Goa, Daman and Diu Act 17 of 1976).
