Goa Chief Minister Manohar Parrikar’s statement that the charge sheet in the Tarun Tejpal case would be filed within 45 days, only reaffirms that the Chief Minister in rank violation of law is charting the course and manipulating the investigation of the case.
The law requires that the investigation of any criminal case lie in the sole domain of the Investigating officer who at the very most can seek the guidance and assistance of his superior officers. Ministers and politicians cannot interfere or participate in the investigation and this has been reiterated time and again in various judgments by the Supreme Court. But the present Government feels that might is right and none can interfere with its functioning! The investigation of the Tarun Tejpal case is at a nascent stage. It is the investigation officer who after assembling all the evidence will decide whether to file a charge sheet or not. Statements of witnesses have to be recorded and reconciled. It is only the course of the investigation that will decide also how long it will take to complete the probe. So how does the Chief Minister make a statement on filing the charge sheet and the time frame? The interference in the investigation is evident. The final report is already in public domain. Chief Minister Manohar Parrikar is in clear contempt of Court for interfering in the investigation, so are those police officers who have surrendered themselves to the whims and fancies of the Chief Minister and are acting as his puppets.
