Nobody can be above the law. But in Goa the influential and well connected can breach the law with impunity. When this happens the Judiciary needs to step in and crack the whip.
With the Goa Police turning a Nelson’s eye, a petition has been filed before the Panaji Judicial Magistrate First Class seeking directions to the North Goa Superintendent of Police Priyanka Kashyap and Panaji Police Inspector Rajendra Prabhudesai to register an F.I.R against Saaniya Salve daughter of former Solicitor General of India Harish Salve and Advocate General of Goa Atmaram Nadkarni. In a petition filed under Section 156 (3) of the Criminal Procedure Code, the Court’s attention has been drawn that the North Goa SP and Panaji Police Inspector had failed to register the F.I.R against Saaniya Salve and Atmaram Nadkarni just because they were very influential and politically well connected. On 24th April a complaint was filed at the Crime Branch against Saaniya Salve and Atmaram Nadkarni under Sections 45 of the Special Marriage Act, 1954 and Sections 181, 193, 197, 199, 200, 209, 420, 465, 466, 468,471 and 120 B r/w Section 34 of the Indian Penal Code. The Crime Branch Deputy Superintendent of Police Mr. Nilu Raut Desai the same day conveniently passed the buck and sent the complaint to the Panaji Police Inspector for necessary action. In a signed declaration made by Saaniya Salve on 20th January 2014 in her notice of intended marriage filed before the Panaji Civil cum Sub Registrar she falsely stated that she was a resident in Goa for over six months at 105/106 Altess Manor at Caranzalem, in the outskirts of Panaji. This false declaration was made by Saaniya Salve in connivance with Atmaram Nadkarni who is the owner of that premises 105/106 Altess Manor at Caranzalem. The movements of Saaniya Salve besides her mobile phone calls during that period would confirm that her declaration was false and that she never resided in Goa as falsely claimed by her. The Goa Police are in contempt of Court for not complying with the various directions of the Supreme Court and High Courts mandating the forthwith registering of an F.I.R when a complaint discloses the commission of cognizable offences.
