PIO + OCI = OIC Indian Citizenship Act 1955 (amendment) Bill 2014 It deals with 3 main proposals viz 1. Foreigners of Indian Origin when re-acquire Indian Citizenship are required to be resident of India for 12 months continuously before making application for Citizenship. Under some sections, they are required to be ordinarily resident in India for seven years before making application for Citizenship out of which they should be residing in India throughout the period of 12 months immediately before making an application for registration (see some extracts/excepts from relevant sub. Sections a, c, f & g.) RELAXZATION IN THE 12 MONTH CONTINOUS STAY RULE PROPOSED. ALLOWING AGGREGATE OF NOT MORE THAN 30 DAYS BREAK IN THE 12 MONTHS PERIOD. 2. Minor whose either or both parents are Indian Nationals can now apply for OCI (or new OIC) 3. Merger of PIO card and OCI card into OIC or IOC card (Person of Indian Origin + Overseas Citizen of India = Indian Overseas Cardholder or Overseas Indian Cardholder ==== Existing Rules: Extract (Partly) Registration as a citizen of India under - section 5(1)(a) of the citizenship act, 1955, Made by a person of Indian Origin who are ordinarily resident in India for seven years before making an application for registration and has resided in India throughout the period of 12 months immediately before making an application for registration Docs Required: - Proof of Indian Origin documents of applicant / parents Valid Foreign Passport, Valid Resident Permit etc section 5(1)(c) of the citizenship act, 1955, Made by a person Who is/has been married to a Citizen of India ordinarily resident in India for seven years before making an application for registration Resided in India throughout the period of 12 months immediately before making an application for registration Docs: Resident Permit, Valid Foreign Passport, proof of spouse Indian origin documents, Passport section 5(1)(f) of the citizenship act, 1955 made by a person who or either of the parents was a citizen of independent India - has been residing in India for one year immediately before making an application for registration.
