I understand your argument on the higher level in point 5).  In practice 
however, a jury in Canada will be fed the law, the jury instructions and they 
then have the task of a guilty or not guilty verdict (depending on how well 
they understood or interpret the law). The judge does the sentencing.

Ronald Opus 6) is a fictional account. It was introduced to get people to voice 
opinions and perhaps find out how the law should be shaped. Making the case 
easier does not get people to think. 
The coming drone intrusion is going to cause a lot of challenges to existing 
laws. Before that happens, should we send a drone to JoeGoaUK? As a friend 
pointed out - a camera with no strings attached.
