By a landmark judgment pronounced today the Delhi High Court has declared
that the Attorney General of India is a “Public Authority” under the Right
to Information Act. The High Court has today reversed the Full Bench
decision of the Central Information Commission headed by then CIC Satyanand
Mishra.

Justice Vibhu Bakhru of the Delhi High Court today held that the Attorney
General of India is a constitutional functionary and is also required to
discharge functions under the Constitution of India and other statutory
provisions. The High Court has further held that the role of the Advocate
General is not limited to merely acting as a lawyer for the Government of
India.

Today’s High Court verdict which will bring in transparency in the
functioning of the Office of the Attorney General of India is bad news for
the very controversial and notorious Advocate General of Goa Atmaram
Nadkarni who also was high-handedly not complying with the mandate of the
RTI Act. He will now have to fall in line.
