http://oheraldo.in/node/25311 British couple ordered to leave country BY HERALD REPORTER PANJIM, JUNE 6 — The Bombay High Court at Goa has vacated the interim relief granted to a British couple wherein order of the Foreign Registration Office (FRO) was stayed. A Division Bench of Justices S A Bobde and N A Britto had stayed the order of FRO ordering a British couple to leave the country within 15 days ( by May 10, 2007), pending the hearing. Dean and Gillian Latimer both British nationals residing at present in Siolim had approached the High Court against the FRO's order and cancellation of theirs visas which they claimed was up to August 30, 2007. They claimed they were not given an opportunity to show cause or justify their actions nor had the FRO given clear reasons as to why they were asked to leave the country within 15 days and why their Visas' were cancelled. The Assistant Solicitor General of India Carlos Ferreira had told the Court that neither the state government nor the police have the right to deport anyone and they can only recommend to the Union of India to deport a person. Finally, the decision to deport or not to deport lies with the Central government. When matter came up for hearing on Tuesday, Ferreira brought to the notice of the Court that the petitioners had only applied for extension and there was no specific document of grant of extension of visa by Central government. The couple had come to India on employment Visas (Type X) in September 2004 and had purchased property in Goa in 1999. Foreigners have to obtain the permission from RBI for purchasing property in India but in this case British couple had not sought such permission.
