*Arguments of Adv. Rajeev Gomes in the Loyola School student assault case* 1. The complaint states that the student's face was swollen and he had bouts of vomitting. If so, how did his parents not find anything awkward in their son's appearance or his conduct on 27th and 28th.
2. The offence took place on 27th. However the complaint was filed only on 29th. Why was this delay?? Wasn't the delay sufficient to frame false charges and fabricate facts ?? 3. The complaint speaks of a merciless assault on the boy with fist blows and kicks - not slaps!!! However the student has claimed in his interview to the media that he was slapped - No fist blows and kicks.. If the incident is true why such a huge contradiction on a material aspect?? Proves clear cut fabrication. 4. If he was mercilessly assaulted with fist blows and kicks on his eye, ears, nose, face, neck, abdomen, etc. how is it that there is no external or internal injury found on that student?? 5. The Medical Officer at Hospicio has clearly opined that there is a possibility of the student feigning injury and therefore requires psychiatric evaluation. 6. The student attended Catechism classes at Our Lady of Rosary Church, Fatorda on 28th (next day) at the instance of his mother.. If he was smashed and battered, why did his mother force him to attend Catechism classes ?? 7. The complaint was drafted by an expert and handed over to the police ?? If the complaint was true why didn't the complainant directly file the complaint orally at the Police Station?? Wasn't it because he wanted to fabricate the facts himself and then file the complaint?? 8. The Cctv DVR has been available at the school but has not been attached by the police till now. Why hasn't it been attached by the police ?? In fact only on 31st a letter was issued by the Police to the Principal to produce the Cctv footage.. The management of the school went several times to the police station to hand over the footage. But the concerned investigation officer was not available. 9. Besides the bare statement of the student there is nothing on record to corroborate his version. The statements of the other two boys are still not recorded. 10. Can anyone believe that the well disciplined Principal could assault a student with fist blows and kicks in an open school corridor in the presence of other teachers and students?? 11. The Principal has been working in the last for the last 7 years... has an unblemished record.... how can he suddenly turn into a monster ??? 12. The father of the student had a grudge against the Principal as he was castigated by the Principal for not complying with certain formalities for subject changing and was not taking interest in reforming the misbehaviour of the student, though being summoned to the school on several occasions to address the issue. 13. The offences with which the Principal is charged do not warrant custodial interrogation and therefore his arrest is not required. Kindly circulate in all groups so that the truth is known.
