LAW AND ORDER IN OUR NATION
Reading an article on doctors versus judges on why it is unfair for doctors to 
get punished for wrong diagnosis/operations, not judges for wrong judgements 
struck me as very relevant. Litigants have gone through jail/suffering due 
wrong judgements proved later on?Whole families have sufferred. Doctors may 
have less time to diagnose than judges to give decisions? In the dowry 
directions of July 2017, the police reportedly had no powers to directly arrest 
unless they go through a Family Welfare Committee. This must have been ordered 
to prevent corruption and excesses by the police, as there were many cases of 
dowry harassment due vendatta and other reasons! It therefore struck me as odd 
that without carrying out the much needed police reforms and with our 
apparently trigger happy "caged parrots" these days, the Committee is now done 
away with, by a bench chaired by the CJI. Police powers are restored with 
certain cautions which are subjective. Also to state that the previous 
direction was " not in accordance with the statutory framework" diminishes the 
learned Supreme Court judges who took that decision?The real reason is bad 
governance. The Legislature and the Executive are responsible for bad laws/ too 
many laws and selective or poor implementation. The judiciary is forced by PILs 
and observing trampling of human rights to come to the rescue/ issue orders in 
public interest. 74 year old Swami Agnivesh manhandled twice by right wing 
activists with impunity was toll by the Supreme Court to approach the High 
Court for a CBI probe since "Wecan't prevent threats to our lives, how can we 
prevent these to you?". What kind of governance is this?
