All over India, it appears now , no information is given by the Government
except under RTI. Here too, I have found cover up encouraged and no justice
from the Apellant Authorities. Incidentally ,I find they are generally,
ignorant of the letter and spirit of RTI.
I read today that two Judges of the Supreme Court have gone against their own
Judgement by a larger Bench stating , inter alia, the Judiciary must have a
Hands Off policy regards the Executive Jurisdiction! The last bastion is being
stormed! Judicial activism was essential when the powerful Executive failed in
its duties and public had to file PILs! Courts are meant for Justice, not to
be manipulated by "Technical Reasons" to deny Justice. The procedures are not
more important than equitable Justice FOR ALL. We can expect many more Naxal
activities and Nandigrams!

Reference appeal 79/2007-8/Mam JEG versus PIO Bardez and first
Appellate Authority Bardez, when my case was called for Orders on 6th
Dec, I went in alone. The SCIC and SIC jointly said they find no merit
in my appeal and it is dismissed without costs or exemplary damages! I
should collect their Orders. "Next! " I was incredulous, and on obtaining
the Order ,left speechless for quite some time! The Order blandly
states Respondents were also present in person ! The Order must have
been typed and kept ready,because I sat with the Secretary who got it
for me within a few minutes of coming out of the Chamber! The
Mamlatdar and Dy Collector were mildly pulled up in the Order, and their
Honours "HOPE" that they will take into consideration the observation of
the Commission in future. No penalty or consequences.So no Fear for
lapses. At the hearing, the Mamlatdar was stuttering and stammering and
couldn't answer anything as he was new. Even his written reply says that
they furnished information to me "inspite of the fact that the office of
this Respondent is always overburdened with different types of work."
The Order says "Information given by the Mamlatdar is complete on all
points".
Something is terribly wrong, because the SIC were giving good decisions
last year. This will require a lot of time and expense to challenge
in our heavily overburdened courts. There are procedures and orders and
Rules which are not followed with absolute cover up! The Aam Admi by
himself, has little chance if he goes about things legitimately! I
can foresee Nandigrams in Goa, if this sort of blatant injustice in
handling of grievances is resorted to. My name is still not on the
Electoral Rolls to date (I have many letters assuring me ,as before
when it didnt come!) and I have to continue to try to improve the
UNCLEAN ROLLS prepared with the little information I have managed to
obtain. Believe me, this even little information obtained shows a
shocking state of affairs!
