-- Dear Frank, Did the 'medical report' confirm WHO raped the young girl? Can the 'medical report', at this point, confirm WHO raped the young girl? I suggest to you that (unless DNA material is available) ALL that the doctors can confirm is that "in all probability" the child had sex with someone or something. (In the past, especially in certain parts of Northern SW India, test-tubes from college labs were the favoured 'something' for sexual activity. I ask, In a HYPOTHETICAL case, Can a 'medical report' (unless DNA material is available) prove that o senhor test-tube or colonel banana was not involved? And, barring a confession by the alleged perpetrator(s) or video evidence or corroboration by an eye witness or another individual who also may have been involved, May I ask whom the police should arrest? Mark you, I understand the bizarre law as it stands in Goa. In Goa, an accused has to prove that he did not rape the victim concerned. The State (i.e. police/prosecution) does not have to prove that. Could you (if you are in Goa) or Aires prove that you guys did not rape Jamina (a fictitious name) - according to the strange Goa laws? Honestly, initially I thought that this was some Kangaroo law that Goa had enacted. Now I am beginning to believe that this is how 'lawyers' and politicians at the time permanently got rid of political and 'land' opponents using the equally bizarre "law" of the Inquisition. sincerely jc
