DANGEROUS TRENDS
Like Mayawati, successfully brainwashing the dalits to back her as their
champion through every excess and accumulation of wealth, we have Madhu Khoda
cocking a snoot at the enforcement agencies and campaigning in Jharkhand with
two fingers in victory at huge rallies of his vast followers. We have the Red
Corridor in India, with Maoists controlling huge areas where the government's
writ does not run.
For too long the Judiciary, though held in the highest esteem, has been a law
unto itself, unanswerable to the government or the public. The Judiciary made a
big fuss about judges having to declare their assets, and are now in absurd
confrontation with the High Court as regards RTI being applicable to them. With
Chief Justices being accused of favouring relatives, current CJI recommending
removal of sitting judge of the Calcutta High Court for corruption and
Karnataka Chief Justice being accused of land grabbing, the intense scrutiny of
the judiciary is inevitable.Widely reported is the recent dismissal of the
petition challenging the reappointment of the court staff by the Goa bench of
the Bombay High Court(Even Shiv Sena dares not make it "Mumbai" HC) on the
grounds that the petitioners have no locus standi. The petitioners were armed
with information obtained under RTI and wanted the court administration to
follow the rules of promotion ,transfer and
recruitment as per rules and the law .The court not only dismissed the
petition but imposed a cost of Rs5,000/-! Is this a rightful decision? Perhaps
the same petitioner having another pending PIL raising objections to the
malaise of re-appointment of retired persons in  various government departments
has something to do with it?
