MARGAO: A lawyer representing John Fernandes, arrested by police in the case of 
alleged rape of a Russian woman at Colva last year, argued before the district 
and sessions court on Monday that the accused is entitled for bail as a false 
case was filed against him by the victim to extort money. 

During the hearing of the bail application, Fernandes' lawyer, Aswin Naik, said 
"The entire case is fabricated in order with the intent of extortion of money 
from Fernandes by the victim," Naik contended that if the claim of the victim 
about the rape is correct, then it is important to know as to why she did not 
mention about the rape in her first complaint to the police. 

The theory of rape was raked only after the case was handed over to the crime 
branch, Naik said and alleged that "statement filed by the victim with the 
crime branch investigating the case on December 5 mentions that she was raped 
which was not the case in the earlier statement and the two statements differ 
invariably". 

He further stated the entire investigation in the case by the crime branch till 
now is based on false evidence and fabricated facts with an intention of 
maligning the image of Fernandes. After his arguments for over two hours, the 
court adjourned the matter for Tuesday to hear the counter arguments of the 
public prosecutor. 

Meanwhile, Fernandes has moved another application at the sessions court on 
Monday asking for some sections in the charge sheet against him to be dropped.
