Pass Goa Succession Bill after changes: Committee TNN, Aug 3, 2010, 06.07am IST
PANAJI: The select committee on the Goa Succession, Special Notaries and Inventory Proceeding Bill, 2008, has referred it back to the Goa assembly on Monday. The committee, headed by MLA Francis D'Souza as chairman, examined various suggestions and objections made by citizens, advocates and the Goa Legislators Forum to incorporate changes in the bill. These were then referred to the law department and incorporated in the report. The bill seeks to consolidate the various provisions of law relating to succession and inventory proceedings in property matters, and notaries into one "comprehensive, rational and integrated legislation to facilitate their application and implementation by the bench, the bar and litigants". The provisions of the law relating to succession, notaries and inventory proceedings were scattered in the Civil Code, 1867, Civil Procedure Code of 1939, notarial law and other decrees issued during the Portuguese era, the report stated. All these had become laws of the land by virtue of Section 5 of the Goa, Daman and Diu (administration) Act, 1962. But the original text of these provisions was dispersed in various enactments in Portuguese and litigants faced hardship in their application and it led to delay in disposing of cases. Following social changes and new scenarios, the government felt the need to amend the law to cope with fresh requirements. Some original provisions have also been incorporated. The bill covers several subjects, such as succession, management of inheritance, transmission of ownership, execution of wills, partition and other property matters. In a series of meetings, the committee examined the changes and drafted the report incorporating them into a report on July 16. The bill had been first introduced on January 14, 2005, and was later referred to the select committee, but after dissolution of the house, the bill lapsed. However, the bill was again introduced on August 29, 2008, and referred to the select committee.
