The ongoing saga about the sale of Church properties is getting more
interesting. Here is a reply by Arcanjo Sodder, a High Court Advocate, I was
sent an email by Arcanjo Sodder with similar content:-

Excerpts:-

Dear Sir,

I have read the contents of the article “ Church Land: Going Going Gone”
written by one Fr.Dominic Savio Fernandes Spokesperson-Archdiocese of Bombay
which has been published in your newspaper “The Examiner” dated October
16th, 2010 which is published weekly and has a printed version , and also
has an online edition and without prejudice to any of my rights and
contentions I wish to put the correct facts on record:

Fr.Dominic Savio Fernandes has deliberately suppressed information from the
readers by claiming that there is only one agreement signed in the year 1991
where in, all permissions and procedures have been followed between St.
Michaels Church ( the owner) and builder Suraj Estate Developers Pvt.Ltd.(
the builder) in order to defame me.

The truth is that there are the following agreements/ writings signed
between St.Michaels Church and the builder Suraj Estate Developers Pvt.Ltd .

1. Agreement dated 31st May 1991( Certified copy Given to the Society By the
Builder)

2. Agreement dated 5th February 1993 ( Certified copy Given to the Society
By the Builder)

3. Deed of Confirmation dated 21st Day of August 2004. ( Certified copy
Given to the Society By the Builder)

4. Notice of motion no.1015 of 2003 in Suit no.2160 of 2001 filed in the
High Court of Judicature at Bombay. ( Certified copy Given to the Society By
the Builder)

5. Agreement dated 15th May 2008

Para 14 of the recital clauses of the said agreement signed in the year 2008
between the Church and the builder Suraj Estate Developers Pvt.ltd. states
that.”… to sell and dispose off premises therein on ownership basis and in
consideration thereof the Developers have agreed to pay to the Owner a sum
calculated at the rate of Rs.2000/- per sq. foot…”

The said rate does not have the sanction of the Charity Commissioner as per
the agreement given to the Our Lady of Vailankanni and Perpetual Succour
Co-op.Hsg.Society by the then trustee Fr.Hugh Fonseca on May 17th 2010.

Dear Mr Sodder,
It will take people like you to get things in the administration of our
catholic Church made straight.

There seems to have been a rapid degeneration in the administration of the
church assets, monies and properities and we as Catholics need to clean up
the system come what may.
I am sure you have a lot of support and you can count on me to be there
always.

God Bless you.

Thanks
Gordon Jacobs

COMMENT: I have been given to understand that this matter is heading for the
Courts.
