Summary: On 7th January 2011, his girlfriend dialled 100 to complain about Cipriano who has threatened to kill her with a knife in his hand. Police arrested him at his Auntie's place, Porvorin a round 10pm same night. On 8th evening Police got him admitted to GMC for he fell down due to attack of fits. On 9th morning around 7, Cipriano died at GMC . - Don’t understand why police had to question him despite of the fact he was fully drunk? They could have waited until next morning when he come to his senses.. - Don’t understand why the girlfriend was there all the time at the time arrest... - Don’t understand as to why police beat (as alleged by GF) the deceased and on whose authority or influence Perhaps, they were told that they will get their dues either in kind or cash. - Why beating while in transport/jeep. Could it be for the money that the victim was carrying on him as alleged by his cousin? May be the deceased was already badly injured before the arrest This could be due to a fall on the ground or dashing against the moving vehicle or even due to severe beating by the Caranzalem villagers all this reported in dailies (see some excerpts ) Beating or no beating, Panjim Police seems to be in serious trouble partly because of its procedural lapse. Moira Resident dies in police custody (NT. 11/1/11) According to SDM (Sub-Divisional Magistrate, Tiswadi) Mr. Shabaji Shetye Georgina Nunes of Caranzalem, girlfriend of the deceased Cypriano, stated in her complaint that the deceased had gone to her house at night with knife and under influence of alcohol, so she called the police. Cypriano Canelio Fernandes (28) was arrested by Panjim Police under sectopn 151 CrPC (Preventive arrest) at around 11pm same night.. Next day (8/1/11) he fell down after he got an attack of fits, and moved to the GMC, Bambolim admitted in ward no. 146 for treatment, He expired at 6.45 the following morning i.e 9th He also informed that statement of his wife, brother and cousin is being recorded in the office of SDM. H dtd 12/1/11 “They started beating up Cyprian even as he was loaded in a police jeep. I had filed a complaint against him because he had threatened me, but I had never thought that he would die due to police beating’’ said Geogina Nunes, the girlfriend. GT 12/1/11 Georgina informed that police had started assaulting him from the time he was taken to the police station in their jeep. After he was brought to the Police station, he was latter taken in the investigation room inside the police station and the door was locked and informed that she heard the voice of he being assaulted by the police inside the room TOI 11/1/11 Oswald Cordeiro, a friend of the deceased said ‘Cipriano was working on a cruise boat and was to leave Goa on 19th to join work. He and his girlfriend had some altercation and he was arrested.. Cipriano has never suffered from epileptic fits. He was working on a ship and this proves he could not be suffering from fits. Custodial Death NT Network dtd 17/1/11 Cypriano Fernandes from Moira-Mapusa, who died at the GMC while in Police custody, was allegedly beaten by some villages of Caranzalem, before he ran to he ran to his relatives in Porvorim, from where the Police arrested him. This was revealed by a source in the Police Dept., who also said Cipriano was under the influence of alcohol when he reportedly threatened his girlfriend at Cranzalem with a knife. The source said that soon after the threatening incident, some villagers who were in the vicinity mercilessly beat Cypriano. In the mean time the girlfriend called the police and Cypriano went to his relative house in Porvorim. It may be recalled that a social organisation has demanded a judicial probe into the incident. TOI dtd 17/1/11 Cops robbed Cipriano of Rs.45,000: Family The family of alleged Custodial death vitim Cipriono Fernandes has claimed that Cash around Rs.45K, an ATM card and one of the two mobiles were stolen while he wsa in police custody. Cypriano cousin Cosme Fernandes has alleged that the victim ws beaten up so that the police could render him unconscious and then rob him of his belongings. Cosme also claims to have pictures snapped by Cipriano on his cell phone while in police custody that show paint from the wall on the victim’s head. When the victim’s articles retuned to his Cosuin Cosme, his ATM card. Nokia Mobile Phone and cash was missing and that Cipriano’s wallet contained only Rs.160. Cosme reasons that Cipriani was earning around Rs.1.80 lakhs per month (as Second Chef on a cruise liner abroad) and as such Cipriano could not have been roaming with only Rs.160 in his wallet. ‘When I went to collect his belongings, one of the policemen recovered Cypriono’s articles from the policeman’s personal scooter and not the police locker’ Cosme alleged According to TOI investigation (dtd TOI 18/1/11) Cypriano informed police that he suffered injuries and could not walk after he met with an accident on the bridge a few minutes before he was picked up by the Police from his aunt’s housee at Porvorim on January 7 night, Police failed to take him (Cypriano) for medical examination. That Cypriano had met with an accident was confirmed by his aunt Rosy Fernandes 60, from whose house the police picked him up. Rosy in her statement to Panjim Police said Cypriano had told her that he drove his scooter in a rash and negligent manner while coming from Caranzalem and fell down near her residence and was unable to walk. She also said that he complained that he had dashed against a truck at Mandovi Bridge and sustained some injuries on his body while coming to her house.; NT dtd 19/1/11 pg.16 Rosy Fernandes, a relation of the deceased Mora resident, has also told the authorities that he was aggressive on the day of his arrest and had created a scene when he came to her house forcing her and her granddaughter to move out of the house and that they returned to the house after Cipriano was taken away by the Police. Interestingly, Mr. Cosme Fernandes, a cousin of Cipriano, had lodged complaint with Mapusa Police on Dec. 30, 2010, stating that the deceased was harassing everybody in the house and that his behaviour was aggressive, He has asked the police to arrest the deceased person so as to protect him and his family. Based on the complaint the Mapusa police had book Cipriano under section 155 of the Criminal Producure Code and produced him before the sub-diisional Magistrate, where he was bound over of good behaviour and released on bail of Rs.5,000 and one surety of like amount.
