Sub: Supreme Court 'ORDER' to free COMUNIDADE LANDS from Private and
Commercial use - A Press Statement for kind favour of Publication.
The Goa Su-Raj Party, while hailing the recent Supreme Court 'Order'
declaring transfer of community (COMUNIDADE) land for private and commercial
use as illegal, congratulates, in no uncertain terms, the Association of
Componentes of Comunidades (ACC) of Goa for this VICTORY.
The Goa Su-Raj Party, which primarily had the restoration of the 'autonomy'
for the COMUNIDADES of Goa in their functioning on its radar scope as the
motive in its formation in the year 2000, feels vindicated in its stand and
thanks the Supreme Court bench of Justice Markandey Katju and Justice Gyan
Sudha Misra for this coup de grace in declaring that the above 'order' is
applicable with retrospective effect.
Starting with the illegal Invasion of GOA by India in 1961, and the
subsequent conspiracy of the Bandodkar regime since 1963, Goa's age old
COMUNIDADES SYSTEM OF community land management was hijacked to favour VOTE
BANK politics. The collusion of the 'Centre' with the successive State
governments of the Congress Party
in Goa to hock the Comunidade lands, especially the agricultural lands, at
throw-away prices, as if it was the God sent 'MANNA' from heavens above,
has been struck-down by the esteemed Apex Court in the sentence used in the
said 'Order'

The Scheme must provide for speedy eviction - Long duration of such illegal
occupation or huge expenditure in making constructions thereon or political
connections must not be treated as a justification for condoning this
illegal act or for regularizing the illegal possession"

This 'Order' will now also pave the way to demolish the Bandodkar regime's
'Tenancy Act' .. having been given the sanctity of 'LAW' by the subsequent
first CONGRESS GOVERNMENT lead by Pratapsing Raoji Rane ( the Mergerist CM)
to free the agricultural holdings of the COMUNIDADES and revert them back to
the lawful OWNERS.
Towards the implementation of the above "Order' of the Supreme Court, the
Goa Su-Raj Party wants to see the first casualty for the usurpers of the
Comunidade land and the victory for the Comunidades in the reverting back to
the original status, the land surveyed under PT Sheet No. 163 - Chalta No.
5/4 with an area of 4100 sq. meters, belonging to the COMUNIDADE OF MAPUSA,
tenanted to Shri. Govind Rama Naik, illegally transferred to the possession
of Shri. Raojee S. Rane and presently under construction at foundation level
right next to the Ajay Supermarket at Morod, Mapusa.
