Over the years we have had some very commendable Judges while a few black sheep have tipped the scales by bringing disrepute to the temples of Justice.
One very outspoken and distinguished Bombay High Court Justice B H Marlapalle <http://timesofindia.indiatimes.com/topic/Justice-B-H-Marlapalle>retired recently. We have witnessed him being a very firm, knowledgeable and a no-nonsense Judge. A principled ethical judge, he vacated his official residence and even surrendered his official vehicle a day after he retired. Justice Marlapalle has set a new benchmark despite the existing norms permitting a Judge to retain the official accommodation and vehicle for three months after retirement. Justice Marlapalle’s gesture is in stark contrast to Judge Nelson Britto whose police security at his residence at Porvorim continued well past his retirement. It was only withdrawn when a complaint was made to the authorities of the unlawful and unnecessary burden to the State exchequer. While Justice Marlapalle’s example should be emulated by others, there are those who just cannot live without that red beacon and accompanying perks. They start lobbing for their post retirement posting well in advance. This does not augur well for a Judiciary that has to be otherwise free and fair and not at the mercy of the politicians for plumb post retirement positions.
