RE: SILENT PROTEST RALLY ON THURSDAY 08 AUGUST AT 3.00 P.M. AT CITY SURVEY
OFFICE , OPP. BUS DEPOT, SV.ROAD, Santacruz.
Harrassment by City Survey Office while transferring Property Cards in
the name of legal heirs.
Please also see the trail email complaint which has been acknowledged
by the Chief Minister's office and passed on to the concerned Department.
The Property Owners in Mumbai are facing lot of issues, while transferring
their ancestral properties in City Survey Offices located at, Old Customs
House, Mulund, Santacruz ( West ), Goregaon. Andheri ( West ),Boravali etc.
The primary reason for such transfer being death of the owners of the
properties. Despite procedure being simple and clear, the authorities harass
the legal heirs of the deceased owner/s. Many Dalals and Middlemen operate in
such offices with the blessings of the concerned Officers of the City Survey.
As a result people are harrassed and mentally disturbed. Many a times people do
not have sufficient means to pay the amounts demanded by such corrupt officers.
Many unscrupulous Agents/Dalals and Builders take undue advantage of such
situation thereby forcing the property owners to sell the properties at
throwaway prices.
THIS IS A WAKE UP CALL GIVEN BY WATCHDOG FOUNDATION, SAVE OUR LAND [SOUL] and
Other NGO's TO ALL PROPERTY OWNERS IN MUMBAI.
We are organising a protest rally at the below mentioned address on Thursday -
8th August 2013 at 3.0 p.m. onwards.

SUBJECT : Proposed Residential Project under SRA Scheme on Plot bearing CTS
Nos.331, 332, 354 -359, 364 -369, 360 (p), 370 (p), 2095 at Village Andheri (
East ), Mumbai, by Panom Developers LLP represented by a) Nimesh Gandhi, b)
Bharat Patel and c) Piyush Shah.
A) Plots belonging to my clients are CTS Nos. 368/1 to 10 ( these plots form
part of CTS Nos. 364 -369 ) stated above.
B) Plots belonging to St. Xavier’s Church, Vile Parle ( West ) are CTS Nos.
366, 366/1 to 15 ( these plots form part of CTS Nos. 364 -369 ) stated above.
C) The Panom Developers LLP moves SRA for declaring the subject plots as
notified slums on 29th December 2012.
D) Public Notice dated 22nd April 2013 by SRA to notify the above plots as
slums. See attachment A and B.
E) Mataji Rahvasi Welfare Society ( slum dwellers society ) objects to the
proposed declaration of the said plots by their letter dated 9th May 2013. We
do not have copy letter dated 9th May 2013 but the same is mentioned in letter
dated 4th June 2013. ( see F below ).
F) SRA issues hearing notice to Mataji Rahvasi Welfare Society and the Builder
by their letter dated 4th June 2013. See attachment C.
G) Fr. Theodore Fernandes, Trustee of the St. Xavier’s Church, by his letter
dated 12th June 2013 objects to the inclusions of the Church plots as
designated slums. See attachment D.
H) SRA issues hearing notice to St. Xavier’s Church by their letter dated 4th
June 2013. See attachment E.
I) Watchdog Foundation by its letter dated 28th June 2013 raises objections
before MSEAC, SRA, etc. See attachment F.
J) Fr. Theodore Fernandes, Trustee of the St. Xavier’s Church, by his letter
dated 1st July 2013 to SRA seeks adjournment of hearing, since no proper
documents were served on him. See attachment G.
K) Even before the plots being declared as slum under the Maharashtra Slum
Areas (Improvement, Clearance and Redevelopment) Act, 1971, by SRA, Panom
Developers submit proposal on 8th September 2011 to Maharashtra State
Environmental Appraisal Committee seeking environmental clearance for the
subject plots under SRA Scheme. ( Please type “Panom Developers” on google and
you will notice the list of proposal received by MSEAC – see Sr. No. 271 ).
L) The 6th MEETING OF SEAC (II), MAHARASHTRA, held at Maharashtra Economic
Development Council, Board Room, 3rd Floor, Y. B. Chavan Centre, Gen.
Jagannathrao Bhosale Marg, Near Mantralaya, Mumbai- 400 020 from 29th, 30th
November and 1st December 2012, lists the proposal of Panom Developers for
environmental clearance for the said SRA Project. ( Please type “Panom
Developers” on google and you will notice the said proposal received by MSEAC –
see Sr. No.1 ).
M) My client’s case in short is that their father owned CTS Nos. 368/1 to 10,
which he agreed to sale to one Mr. Matadin Mishra vide Agreement for Sale dated
9th June 1960 ( see Ex. F of Appeal Papers ), since the transaction did not
materialise the sale was not completed i.e. the Conveyance Deed or Sale Deed
was not executed.
N) The said Mr. Matadin Mishra however forged the signature of my client’s
father and got an Indenture (Conveyance Deed or Sale Deed ) executed on 11th
April 1963. ( see Ex. D of Appeal Papers )
O) No steps were taken by Mr. Matadin Mishra or his children on his death to
change the land records for almost 49 years.
P) When my client realised that Panom Developers who have purchased CTS Nos.
368/1 to 10 from the legal heirs of Mr. Matadin Mishra, they objected to the
transfer of revenue records in the name of Panom Developers.
Q) The City Survey Officer, Vile Parle Mumbai vide his order dated 30th May 2012
held that there was a delay of 49 years on the part of the Respondents ( Mishra
Family & Panom Developers ) and there were differences noticed in the signature
of Mr. Anthony Joseph Misquitta ( my client’s father ) in the Agreement for
Sale and the Deed of Conveyance dated 11th April 1963. ( see Ex. S of Appeal
Papers ).
R) The Panom Developers thereafter went in appeal ( read managed the authority
) and got the order dated 30th May 2012 passed by City Survey Officer, Vile
Parle Mumbai reversed.
S) The Panom Developers managed to get the huts standing on the some of the
above plots demolished during heavy downpour on 18th July 2013. ( see attached
photos )
T) The Panom Developers forcibly fenced the property without BMC approval on
19th July 2013, when my clients complained to Andheri Police Station, they were
directed to Vile Parle Police Station and were made to wait and builder was
allowed to complete the job.
