I'm not sure about that. I think you missed the Customer Content definition, from the terms:
"Customer Content means content provided, generated, transmitted or displayed via the Service by Customer, as well as any content provided by End Users through use of an Application." I think the above is quite clear. Besides, what happens in reality (at least, in my experience) is that people and orgs that want a total data lock down in EU won't use your app/service having the above definition anyway. So, I'm pretty much happy with the Safe Harbor.
