It seems the project is now up again. I am still pretty certain the project is in violation of the TOS, especially seeing as though my requests for the source have been ignored. The person who registered the project evidently contacted you to bring it back up, which goes to show that he is selectively ignoring e-mails.
I don't have anything personal against the project author, but I really don't think it belongs on Google Code.
