It's perfectly fine for opensource projects to use Google Code projects 'a la carte' -- just the issue tracker, just downloads, etc. *As long as they're open source*. In other words, the source code needs to be available *somewhere*. Ask the project owner for the source. (I didn't see a reference to it on their main website.) If it's not available, then yeah, they're violating the terms of service.
