Could it be that the api uses the email as a unique identifier of each contact entry? This may allow you to create one with an empty email, but for sure would fail when adding the second as it would appear to be a duplicate of the first (perhaps with other information that is different). If the api developer requires an email for contact creation, then you would get an error when adding the first contact without an email address.
