I wonder if it might have something to do with where the request is coming from... Could there be a difference between the Windows Live platform and the Google platform that the server side is seeing 2 out of every three times?
It really doesn't sound like a problem with the gadget per se (I'm far from an expert on this though, so somebody else might see the problem)...
