I think it should be possible to use a theme that hasn't been listed in the directory without having to have the &skin= thing on the URL. That way, if you don't want to share your theme, you don't have to, and if a theme violates the terms for being added to the directory, you can still use it normally. What if you want a pornographic theme? (I don't, in case you were wondering.)
