I have a question about licensing relating to the use of custom tile
overlays.

In my application I'm developing an editor for a custom tile overlay
which will include a free (basic) version and a premium version (paid
for) which will include more features. Users of the application will
be able to publish their resulting maps for free, accessible by URL,
or optionally keep their tile layer private if they wish.

Would this require a Premier license?

Looking at the FAQ (http://code.google.com/apis/maps/
faq.html#tos_commercial) the line:

"If you charge people to place information on your map (e.g. to list
their homes for sale), but you display this information using the
Google Maps API on a free part of your site, you'll also meet the
Google Maps API Terms of Service"

To fulfill the terms of service, would I require users to always
publish their custom maps, and not allow them to be private?
