If you're trying to do all that on the desktop, then that would be a violation of the Terms, whether you use Google Maps API or Static Maps. They both require that the data only be displayed in a publicly accessible website.
If you're trying to do it in a website, then don't try to make the map into a Google Earth API screen overlay. Run the Google Earth API and the Google Maps API side by side on the same page, each doing their own thing, without any direct communication with each other.
