I am aware of the technical issues with using the maps api on the
iphone.

I am trying to get my head around the new google ToS as they relate to
the iphone. (I have read various recent threads on them.)

In particular this one:

10.4 charge users or any other third party any fee for the use of the
Maps API Implementation, the Service, or the Content, unless you have
entered into a separate written agreement with Google or obtained
Google's written permission to do so (but if you are a consultant who
creates or hosts Maps API Implementations for third party customers,
you may charge such customers a fee for your consulting or hosting
services);

1) As I understand it, (and I may be wrong) wrapping the url of a maps
implementation up in objective-c (to allow touch pan/zoom support) is
no longer illegal (?)  (The url is additionally accessible from any
webbrowser, the objective-c wrapper still parses it through what is
basically webkit...)

2) One can't charge for such an app - it - it would have to be a free
app at the iphone store.

Question: if one built a second, paid app that additionally made the
iphone GPS available to JS (hence one could plot one's position on the
map), could one sell that?

This lat/lng one would pass in is arguably "Your content" in the
language of the ToS

that uses the Maps APIs to obtain and display Content in conjunction
with Your Content, according to these Terms.

On the face of it, it looks like "your content" is part of the "Maps
API Implementation" and 10.4 rules it out....

If it IS still illegal - which the above suggests..., is it the case
that ANY paid iPhone app, no matter how much non-Google maps
functionality it has, must be free if it shows a google map, however
small that is an element of its overall functionality?

In case any one is interested, the motivation for these questions is
that the iphone Google Maps  app shows the Japanese tile version, not
the English tile version and I want to knock up a decent offering with
a Japanese map showing the English tiles.

I then want to offer English language lookup of Japanese addresess on
to it, which I can do, but google still can't - with proper ToSch pan/
zoom.

But I do need at least some prospect of a revenue stream as
diddlefinger.com is operated essentially as a public service (adsense
does not make much and is not really suited to the iphone in any
case...) and is much used by overseas residents of Japan. At least
until google provide full address support in English here....
