It *does* follow the z-index; but the map div is set so that overflow is clipped. If you want something which visually extends outside the map area, it can't be part of the map. Have a look at Mike's EBubble http://econym.org.uk/gmap/ebubble.htm -- there are almost certainly other implementations as well.
