I'm awaiting an email from Sanjay Patel to help clarify the position
on the new TOS google released late last year relating to real time
tracking.

It's been a few days since I sent the email and was wondering if
anyone could help resolve the issue quicker before we release the semi-
open-source code to the public.

Our understanding of the new terms permit us to give away free
software
providing that.

9. License Requirements

9.1 Your Maps API Implementation must be generally accessible to
users
without charge. You may require users to log in to your Maps API
Implementation if you do not require users to pay a fee.

=YES... Users download & install our free web software application and
log in to their own website to use the application, much as you would
install something like phpBB, its semi-open-source.

9.2 Reporting, setting sensor=true

=YES, this new setting is set to true in the application and the users
can not change it.

9.3 If you develop a Maps API Implementation for use by other users,
you
must:

a,b + c = YES, all users must enter their google map key to use the
application and are made aware that they are agreeing to googles
terms,
terms are also displayed on the map.


10. License Restrictions.

10.4 must not charge users or any other third party any fee for the
use of
the Maps API Implementation

= YES, The software is available for 100% free download and use
without
restrictions.

10.9 (c) (the Google Maps APIs can be used to track assets (such as
cars,
buses or other vehicles) as long as the tracking application is made
available to the public without charge.

=YES... our application is 100% free and installs on the users server
for
single use for tracking on a personal level using software or hardware
in an
asset such as a car.

While we are awaiting clarity on this we are also keen to hear from
developers who wish to help build the next generation tracking
application for free, yet still be rewarded for their time and
dedication to the project by having their adsense code embedded in the
hard-coded protected files if their *functions* or *modules* make it
into the gtrack application.

For example, if you write a cool function using the
myCustomFunction.php script and gtrack adopt it in to the hard-code,
your adsense code will be included in a pool of other developers and
become available on each deployed application, on each page load.

Developers can also write complete new bolt-on modules relating to a
trade, to complement the tracking data and build complete back ends
relating to each users own needs, this is where we expect gtrack to
flourish.

Our objective is to produce the best-free-semi-open-source tracking
application available on the net, with developers keen to help out
adding new features + modules for all types of back end applications
that 'merge' with the gtrack database & users own current database on
the web.

We plan to launch gtrack at the end of Jan 09, all other software,
such as Windows Mobile 5 + 6, Java + Laptop tracking software is
included in the download, so users can instantly have their own
tracking application on their own website instantly and for free.

Please note: No files are available to download yet as we are still
testing, and porting the application from MSN Maps which it was
originally built for (but then google changed its terms :-) )
