Thanks Mike, After rewriting the code to keep calling setTimeout to invoke a function that tests the DIV availability before proceeding, the code now works for MSIE-8 using API v2.142. However, I did reorganize and add more code to restyle the overview control so I cannot guarantee the DIV unavailability was the sole problem for MSIE. There could be other timing considerations going on behing the scenes I'm not aware of yet.
