Long time API developer here, looking for a second opinion on this.

I have a site that is open and free of charge to everyone that is
interested.  However, there are a certain subset of site visitors that
would like a more advanced or diverse search to manipulate and display
data on the map.  I would like to open a revenue stream so that these
visitors can have access to this advanced search capability.

My ultimate question is this -- keeping in mind that the same map
would be used between paying and non-paying visitors, would this type
of setup be in violation of the ToS?  There would be no difference in
the type of data being displayed, just the way in which the user would
have the ability to display and manipulate map information.

My personal feelings are that it's borderline, but was curious to see
what others thought about it before taking the plunge.
