Is it a problem? Hmm.. Depends. The Google Terms of Service say that the map has to be publically available.
As far as your problem, it's hard to give you an answer without being able to look at the complete code and debug on the spot. I would start with the basics: Can you browse to test.xml and see that it a correctly formatted XML document? Can you test to ensure that as you looop through the markers, you're getting the correct data?
