I said ToS, not TOC, and in any case your link it to the FAQ.

Point 10.3 - You may not..
"... pre-fetch, cache, or store any Content ..."

That means you may not scrape tiles, which is what you're doing, so I
disagree with Barry here, because although you're not using the
javascript API, the tiles are also part of "the service".
