I am developing a commercial web service based on Google Maps, and I
want to make sure I do not violate the terms. This paragraph is what
is troubling me:

10. License Restrictions. [...] you must not:
10.4 charge users or any other third party any fee for the use of the
Maps API Implementation, the Service, or the Content, unless you have
entered into a separate written agreement with Google or obtained
Google's written permission to do so (but if you are a consultant who
creates or hosts Maps API Implementations for third party customers,
you may charge such customers a fee for your consulting or hosting
services);

I am hoping that my service falls under the "consultant" part, but I'm
not sure. Description:

1. I have created a web service based on Google Maps. It is hosted on
my server.
2. I will try to sell this service to clients, such as cities or
corporations.
3. The clients create and edit maps within the administration area on
my server.
4. The maps are then integrated into the clients own website, which
are all publicly available & free.
5. All data and code is generated by my server. (put on the client's
site through an iFrame)

The question is if I am a consultant? My understanding of consulting
is that he/she is typically hired by some company. In my case, I am
not hired, rather I am selling a finished product. But I still think
it sounds like I fit under the consultant part of the terms. Do you
agree?
