I suggest you just submit your update as a new theme. When (if???) your new theme appears in the themes directory, request that the old theme be deleted.
There is a thread on Google Web Search Help discussions with a reply from Google explaining how to delete a theme. It involves replying on that thread with the URL of the theme you want deleted.
