I wasn't attempting to answer the question of whether or not someone *should
* use the visualization API for a commercial project, but whether or not 
using the API for commercial projects is allowed.

You raise a valid point, though: having the API hosted by Google exposes you 
to the risk that something could happen to Google's servers.  In my case, my 
dev team's client made the decision that the risk was acceptable.
