I'm not a lawyer and I don't work for google, so take this with a grain of salt. The Terms of Service do not prohibit use in a commercial application, though if I recall correctly, you cannot charge specifically for access to the charts (eg, you can't charge more for application with charts than application without charts). You cannot, however, host the API locally. All access to the API must go through Google's servers.
