I vaguely remember there being cross-browser issues with this approach, but I just tested IE9, IE7, FF3.6 and FF4 and things look good so far with your new approach. Modernizr even wraps this check in a try/catch, but I think both their approach and our existing one are for supporting beta versions of browsers that no longer exist. LGTM.
