I see. The problem at hand doesn't have a good short term solution and I
share Nukeador's and your concerns. The reason short term doesn't have a
good solution is that as you point out, the Mozilla marketplace is
currently the only one out there.
But, medium/long term, it's possible to create other marketplaces (that
also allow to install privileged apps) that fall under other
jurisdictions. I don't think there is such a marketplace yet, but it can
exist.
A question is: how would these marketplaces get traction? And here
Mozilla can play a role. Mozilla (the Foundation and Corporation) is
based in the US and probably can't host a marketplaces that doesn't
comply to DMCA. But if judged fit, Mozilla can appropriately use its
resources to promote other marketplaces. If appropriate too, Mozilla can
build tools that help publishing an app to different marketplaces.
