The practice to date has been that the practitioner holds, if not owns, the record. Deviation from that, and its security and possible benefits are speculative at this point.

What occurs in other jurisdictions with other traditions doesn't really make much difference here and now. There are many reasons to think that the risks from the changes you suggest must be reasonable and tested before the leap occurs.
