I thought this was pretty innocuous. You are quite entitled to point out that the print is quite small.

You might be able to show that the product you ordered was not quite what you ordered and that it was not sufficiently robust for a PDA. These devices are well known for their inability to handle complex programs and perhaps there are errors in the application.

 

The Trade Practices Act is quite specific in that if you are sold a lemon that you are entitled to some relief.

 

I would even venture that if you were to take it  before a magistrate and explain your situation that you might even win.

 

There is another factor in this – the Home Office is in Adelaide. They have a poor understanding of the rules and regulations applying to various publications. I am still waiting for the writs and injunctions relating to my publications in May and despite my further publication of my side of the story am still waiting for an apology from the censors on that site. When I published it here, there was a great outcry and Horst, being the honourable person that he is, pointed out that the censors were having kittens and asked me would I consider removing it. I agreed to this on the basis that the Good Lord was not answering their prayers and that I could feel a bit more powerful than God – I almost felt I had Horst on a string. It was a real Power Trip.

 

Should the matter involve any further legal action I should be prepared to support your costs. Don’t let the bastards intimidate you nor shut you up.

I may not agree with you but I will help defend your right to say it. You realize that they may take out an injunction against you publishing in Adelaide but I am not sure that they can enforce it if you do not live there. The question of where you publish it and where someone else reads it has yet to be determined objectively.

 

I can see no sign of anything other than a straightforward ‘purchase’ on the website. I do not see ‘subscription’ clearly articulated on the website.
