Think you might be a bit off the mark with the Dell theory.

Dell did have zero configs on their website with XP for a few weeks but it
could still be preinstalled, you just had to ask.

We jumped up and down as Dell system integrators saying business just cannot
use Vista yet as most of our client line of business apps are not tested
yet.

Suddenly we had the choice again on the Dell website.

Notably XP was always available on the US Dell website. I only noticed it
missing from Aust.

 

Another issue is the lack of corporate AV for Vista.

So Dell's decision was a business one and I find it hard to believe
Microsoft will be slapping someone as big as Dell over the wrist. Dell has
been offering Linux or no operating system preinstalled for quite a few
years now.
