  THIRUVANANTHAPURAM: The Kerala Cabinet on Wednesday decided to recommend
an ordinance to retain its control over the police. The decision was taken
in view of a Supreme Court directive taking away the powers of the State
Government to control the police to a substantial degree.

The Court had directed the States last year to form State Security
Commissions to reduce "unwarranted" influence on the police and ensure a
minimum tenure of two years for the Director-General of Police.

It also mandated that each State should have a Police Establishment Board to
decide transfers, postings, promotions and other service-related matters of
officers below the rank of Deputy Superintendent of Police. A Police
Complaints Authority should be established at the district level to look
into complaints against officers of and up to the rank of Deputy
Superintendent of Police. The investigating police shall be separated from
the law and order police to ensure speedier investigation, better expertise
and improved rapport with the people.

The ordinance is intended to bypass the Supreme Court order, while
implementing the other directives of the Court. Chief Minister V. S.
Achuthanandan said the implementation of the Court order would limit the
powers of the State Government. The ordinance would "protect the interests
of the State, he said."

The Chief Minister said the Government had given due consideration to the
directives of the Court while drafting the delegation.
