The commission's declaration comes about two months after a high-level committee had come out with a report alleging caste-based discrimination and denial of opportunities to the SC/ST community.The national commission had a meeting on the issue in which the health secretary, Mr Naresh Dayal, and AIIMS director, Dr P Venugopal, also participated. "The reservation policy being followed by AIIMS is unconstitutional, not followed by government of India," commission chairperson Mr Buta Singh told The Statesman. The institute has been following this policy since 1986. AIIMS has been following a "floating" reservation policy which had also come in for criticism by the Thorat Committee. Under this policy the reserved seats in a particular stream, if suitable candidates are not available, could be shifted to another discipline. Besides, candidates who are selected on the basis of their own merit are shown as reserved candidates. The chairperson of the National Commission for Scheduled Castes said this policy had no place in the rules and law of the country. "We will call a high-level meeting, most probably in the first week of August, with members of the AIIMS governing body, health ministry, AIIMS officials and others concerned to fix responsibility as to who introduced this policy at the institute," Mr Singh said. The report would then be sent to the President. "The commission would introduce the legal policy," he said. The Thorat committee in its report had observed that the institute was following a reservation policy "which is unique to itself, not sanctioned by the Constitution or the directives of the Central government while selecting junior residents (post graduate students). These mechanisms effectively denied a good number of opportunities to the SC/ST community". Non-application of the post-based roster system in the selection of senior residents at AIIMS is a serious constitutional violation, it said. The report cited an account given by an SC doctor who topped the exam for an advertised seat of senior resident in laboratory medicine in trauma centre.
